I am on Roosevelt Avenue and Junction Blvd in Queens when a police van directly in front of me signals to turn left. My car is stopped at that point. I slowly pass him on the right side and another police cruiser is making a U Turn in the middle of the intersection. I did not see him while I was behind the police van but I did stop with plenty of room. He stopped and I went. Half a block later the u turn officers lights flashed and I knew it was over. Throughout the stop I was very polite, I actually have some friends at the 115th precinct but I still ended up getting a ticket for reckless driving and a ticket for "Plates covered rear (clear plastic)". Now I have a few questions I hope you guys can help me out with.
1. What are your experiences with the reckless driving charge? Some lawyers websites make it sound like 2012 mixed with Terminator while this nice ehow article (first on Google search) claims "Nothing will come out of it because the judge at the court will dismiss it as there is no ground for reckless driving." So just how worried/pissed should I be about this?

2. The incident occurred on Roosevelt Avenue and Junction Blvd but I was pulled over one block later on Warren St and Roosevelt Avenue. The officer must have assumed the incident occurred on 96th st. However 96th street and Roosevelt Avenue does not exist!! If you Google Maps Roosevelt Avenue and Junction Blvd you can see how the officer made this mistake. So with that said, does my case improve with this technical error?
3. I think this is the point I should rely most heavily when I fight my ticket. I believe I had the right to pass a stopped vehicle that is signaling left given that I had plenty of room to pass on the right. Can someone confirm or deny this? However the officer can easily argue that Roosevelt Ave is a one lane road so I am not sure how well that would hold up. I also believe that I had the right of way over a car that is making a u turn when I am going straight. Even cars that make a left turn MUST watch out and give right of way to oncoming cars from the opposite direction.

1. Reckless driving is reckless driving. Just because you don't feel that it was reckless, doesn't mean the court won't.
As far as how "pissed" you should be: Not at all. You committed a traffic violation. THEY should be pissed. You should be apologetic.
2. And where did you see anywhere that they assumed anything about 96th? If it occurred on Roosevelt ave, and Junction, that's where it happened. And no, your case doesn't improve with a technical error. All you have argued is it occurred somewhere else. Exactly how is that a defense? If I kill you in a park, and they say it was a parking lot, it's still murder. So that's absolutely stupid to think that's a defense of any sort.
3. No, you don't have the right to pass a stopped vehicle. Particularly when it's a police van. Your key words: "I believe I had the right". Believing something doesn't make it true.
Where do you stand on this charge? Screwed. Particularly with your weak defenses, and the fact that you arrogantly think that you're in the right. Accept the ticket, pay the fine, don't fly around police vehicles in the future.

You can only pass if its a valid lane of traffic. If its only one lane each way then its illegal to pass. If they give you a ticket and spell your name wrong its invalid as your not the person on the ticket. If they put down an intersection that doesn't exist then there is an argument to throw it out. Speed doesn't matter you could be going 2 mph.
